LEAVE ENTITLEMENTS AND PUBLIC HOLIDAYS
Leave entitlements available to you under this Contract will satisfy the Company’s obligations under the National Employment Standards (NES), the Fair Work Act 2009 ( Cth) and any other applicable legislation.
Leave entitlements
Mr Henry will be entitled to the following leave entitlements:
•
Annual leave – in accordance with applicable Australian law, currently four weeks per annum.
•
Other leave – in accordance with applicable law.
Leave Entitlements
The leave entitlements detailed below are subject to the notice and evidence requirements of the Fair Work Act 2009 (Cth) and/or as detailed in the Company’s leave policy as amended from time to time which forms a lawful and reasonable direction with which you must comply but does not form part of this Agreement.
Annual Leave Entitlements
The Company’s holiday year runs from 1 January to 31 December. In addition to statutory public holidays in Singapore, the Employee is entitled to 25 days of paid annual leave in each holiday year, accrued on a day to day basis.
Leave Entitlements
A summary of your leave entitlements is set out below.
(a)
Annual Leave. You are entitled annual vacation in in accordance with the Company’s standard policy for similarly situated employees or, if no such policy exists at the relevant time, in accordance with the minimum entitlements under law.
(b)
Public Holidays. You are entitled to all paid holidays given to all similarly situated employees in accordance with the Company’s standard policy or, if no such policy exists at the relevant time, in accordance with the minimum entitlements under law.
(c)
Paid Sick Lease and Unpaid Leave. You are entitled to paid sick leave and unpaid leave in accordance with the minimum requirements at law.
Leave Entitlements
Your entitlements to leave are in accordance with the National Employment Standards (NES) set out in the Act and the relevant legislation applying to Long Service Leave. A summary of those leave entitlements are set out below.
Annual Leave
(a)
You are entitled to four working weeks (20 working days) annual leave each year, which accrues on a pro-rata basis in accordance with the NES.
Public Holidays
(b)
You are entitled to public holidays each year in accordance with the NES.
Personal/Carer’s Leave
(c)
You are entitled to ten (10) days paid personal/carer’s leave per year in accordance with the NES if you are unable to attend work:
(i)
due to personal illness or injury; or
(ii)
because a member of your household or immediate family requires your care or support because of his or her illness or injury, or because he or she is involved in an unexpected emergency.
(d)
If you have exhausted your paid carer’s leave entitlement, you are entitled to two (2) days of unpaid carer’s leave on each occasion required in accordance with the NES.
(e)
You will not be entitled to a payment of unused personal/carer’s leave at the termination of your employment.
(f)
You must provide evidence, in an appropriate form, to claim any period of personal/carers leave.
(g)
You must give notice to the Company of your need for such personal/carers leave as soon as possible, together with the reason for and expected duration of that leave.
Compassionate Leave
(h)
You are entitled to a maximum of two (2) days’ paid compassionate leave in accordance with the NES on each permissible occasion:
(i)
for the purpose of spending time with a person who is a member of your immediate family or is a member of your household who has a personal illness or injury that poses a serious threat to his or her life; or
(ii)
after the death of a member of your immediate family or a member of your household.
(i)
Compassionate leave will not accrue during your employment.
(j)
The Company may require production of appropriate documentation in support of any claim for compassionate leave.
Parental Leave
(k)
You are entitled to twelve months’ unpaid parental leave (maternity, paternity or adoption leave) after twelve months’ service, in accordance with the NES.
Community Service Leave
(l)
You are entitled to Community Service Leave in accordance with the NES.
Long Service Leave
(m)
You are entitled to Long Service Leave in accordance with the NES and the Long Service Leave Act 1955 (NSW).
Leave Entitlements
You shall be entitled to sick leave, paternity/maternity leave, and childcare leave, if you so qualify, in accordance with the prevailing Company practice and in compliance with Singapore law.
Leave Entitlements
8.1
Annual Leave
You will accrue pro rata 4 weeks leave with pay per annum, which you will take at such time or times as are agreed with Bionomics. You may accumulate annual leave not taken in the year in which it accrues but Bionomics is entitled to require you to take any significant untaken accrued annual leave at such time or times as the Board of Directors or CEO of Bionomics may specify.
8.2
Sick Leave
You will accrue pro rata 10 days sick leave with pay per annum, which will accumulate if not taken in the year in which it accrues. You may take sick leave whenever you are sick, injured or incapacitated.
8.3
Medical Reports
If Bionomics requires during any period when you take sick leave or are otherwise absent from work due to sickness, injury or incapacity, you will consult a registered

medical practitioner or practitioners nominated by Bionomics and produce a certificate or report from that medical practitioner, as to your state of health.
Leave entitlements
Annual and Long Service Leave
12.1
The Executive is entitled to accrue annual holidays in accordance with applicable law. This entitlement currently amounts to four ordinary working weeks’ paid leave per year of service. Untaken annual leave accumulates from year to year.
12.2
The Executive must take leave at a time that is mutually agreed between the Employer and the Executive.
12.3
The Executive is entitled to accrue long service leave in accordance with the provisions of the Long Service Leave Act 1992 (Vic) or any other applicable law.
12.4
Whilst on such leave, the Executive will not engage in any conduct which is inconsistent with the Executive’s duties and responsibilities under this contract.
Personal Leave
12.5
The Executive will be entitled to personal leave in accordance with applicable law.
12.6
The Executive will not be entitled to receive any payment for any accrued and unused personal leave upon termination or at any other time.
12.7
Without limiting the above, the Employer may require the Executive to be examined by a medical practitioner nominated by the Employer to determine whether or not the Executive is fit for work, and the Executive consents to the Employer receiving a report from such a medical practitioner for this purpose. The Executive will confirm such consent in writing as and when required by the Employer.
Other leave entitlements. The Executive is entitled to other forms of leave including long service leave, compassionate leave, community service leave and parental leave in accordance with applicable law.
Leave Entitlements. Company agrees to 25 days paid holiday annually and 10 days paid sick leave annually. This does not carry over into the following years.
