User referral & affiliate program terms and conditions
Each clause is labeled with the program it applies to: Referrers for the User Referral Program, Affiliates for the Affiliate Program. Unless a clause names one of the two programs, it applies to both.
- Prohibition on self-referrals Referrers Affiliates
Users participating in the referral program are not permitted to refer themselves. Any attempts to refer oneself will result in disqualification from the program and may lead to the forfeiture of any rewards or incentives earned.
- Misrepresentation of affiliation Referrers Affiliates
Participants in the referral program must not misrepresent themselves as employees, agents, or official representatives of fynk. Any false claims of affiliation beyond participation in this referral program are strictly prohibited and may result in immediate disqualification and potential legal action.
- Prohibition on fraudulent and spam referrals Referrers Affiliates
Participants must adhere to ethical practices when referring new users. Any referrals generated through fraudulent activities, spamming, or deceptive practices will be considered invalid. fynk reserves the right to disqualify participants and revoke rewards if there is evidence of such activities.
- Compliance with applicable laws Referrers Affiliates
All referral activities must comply with applicable local, national, and international laws and regulations. Participants are solely responsible for ensuring that their referral practices do not violate any legal requirements.
- Modifications and termination Referrers
fynk reserves the right to modify or terminate the User Referral Program at any time, without prior notice. In the event of termination, fynk will honor valid referrals made prior to the termination date, provided all other conditions are met.
- Modifications and termination Affiliates
fynk reserves the right to modify or terminate the Affiliate Program at any time, without prior notice. A modification or termination can also affect future commissions from customers referred before it takes effect: those commissions may change or stop.
Commissions already earned on qualifying payments made before a modification or termination takes effect remain payable under the applicable payout conditions, subject to the eligibility and anti-fraud provisions of these terms.
- Limitation of liability Referrers Affiliates
fynk will not be liable for any indirect, incidental, or consequential damages arising from participation in the referral program. Participants agree to indemnify and hold fynk harmless from any claims, damages, or losses resulting from their participation in the program.
- Reward disbursement Referrers Affiliates
Referral rewards will be disbursed according to the program's specified timeline and criteria. fynk reserves the right to withhold rewards in cases where referred prospects do not meet the program's eligibility requirements or where there is suspicion of fraudulent activity.
Affiliate rewards and commissions are paid under the self-billing arrangement (see Self-billing). It does not apply to User Referral Program rewards paid out via PayPal.
- Right to audit Referrers Affiliates
fynk reserves the right to audit any referral activities to ensure compliance with the program's terms and conditions. Participants may be required to provide additional information or documentation to verify the legitimacy of their referrals.
- Confidentiality and data protection Referrers Affiliates
Participants must respect the confidentiality of any information they obtain during the course of their participation in the referral program. All personal data collected as part of the referral program will be processed in accordance with fynk's Privacy Policy.
- Discount applicability Referrers
In the User Referral Program, referee discounts are only available for new customers who have not yet signed up for fynk. Referrals to existing customers are not eligible for discounts.
- Eligibility and commissions Affiliates
In the Affiliate Program, a referred business qualifies for the referee discount and the affiliate commission if it has never paid for a fynk subscription. This includes newly registered businesses and businesses that already have a free or trial fynk account. The referral must be validly attributed to the affiliate, and all other conditions of these terms apply. Businesses that have paid for a fynk subscription before do not qualify.
The affiliate commission depends on the referred customer's qualifying subscription payments. Referred businesses do not need to book or attend a demo. A demo by itself does not earn a commission.
- Self-billing Affiliates
This clause applies to the Affiliate Program only. Affiliates agree to self-billing in accordance with applicable EU VAT and tax regulations. fynk issues invoices on the affiliate's behalf for affiliate rewards and commissions. Affiliates must not issue separate invoices to fynk for those payments.
Affiliates must provide accurate, complete and current billing and tax details, including a VAT identification number where applicable, and promptly notify fynk of any changes.
Affiliates remain responsible for assessing and fulfilling their own tax obligations. fynk does not provide tax advice and does not accept responsibility for an affiliate's tax compliance.
Participation in the Affiliate Program constitutes consent to this self-billing arrangement. It does not apply to User Referral Program rewards paid out via PayPal.
- Acceptance of terms Referrers Affiliates
By participating in the User Referral & Affiliate Program, participants agree to be bound by these terms and conditions. Failure to comply with these terms may result in disqualification from the program and the forfeiture of any accrued rewards.
